Twitter Gets One Over Elon Musk with Trial Set to Take Place in October

On Tuesday, Chief Judge at Delaware Chancery Court, Kathaleen St. J. McCormick ruled that Twitter’s lawsuit against Elon Musk for canceling his $44 billion buyout of the company will be held in October over a 5-day trial. Twitter had earlier proposed a September trial period, while Musk’s legal team filed a complaint that the trial should be pushed till February 2023. This is nevertheless a win for Twitter.

According to Twitter’s attorney William Savitt, Musk is expected to close the deal within two days of all required conditions being met. Savitt says the conditions will be met in early September, Bloomberg reports. The Chief Judge at Delaware Chancery Court ruled against Musk’s February trial period saying his lawyers “underestimate the ability of this court to quickly process” complex legal cases in a hearing held remotely on Tuesday due to the judge’s covid case.

Musk officially filed to cancel Twitter’s takeover on July 8, citing “misleading representations” over the platform’s spam accounts. While the exact trial date has not been scheduled, it is now certain the hearing will occur in October.
